OVERVIEW: This website is operated by Pathfinder. Throughout the site, the terms “we”, “us” and “our” refer to Pathfinder. Pathfinder offers this website, including all information, tools, and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.
SECTION 1 - ONLINE STORE TERMS & ELIGIBILITY
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to motor vehicle safety and environmental laws).
A breach or violation of any of the Terms will result in an immediate termination of your Services and may be reported to relevant law enforcement or regulatory authorities.
SECTION 2 - CRITICAL VEHICLE MODIFICATION & OFF-ROAD USE DISCLAIMER
You acknowledge and fully understand that vehicle modifications can significantly alter your vehicle’s handling, center of gravity, stability, braking performance, and overall structural safety.
-
Off-Road Use Notice: Certain Pathfinder equipment, brackets, lighting, and performance modifications are engineered and intended strictly for off-road use, closed-course competition, or stationary camping environments.
-
Professional Installation Requirement: We strongly recommend, and in certain product categories require, that all heavy-duty structural parts, flatbed systems, camper conversions, diesel heater relocation kits, and specialized electrical systems be installed by a certified, licensed automotive modification technician. Improper self-installation voids any implied product performance expectations and poses catastrophic safety risks.
-
Legal Compliance: It is the user’s sole and absolute responsibility to ensure that any vehicle modifications utilizing Pathfinder gear comply with all local, state, and federal laws, including the regulations of the National Highway Traffic Safety Administration (NHTSA) and the Federal Motor Vehicle Safety Standards (FMVSS).
-
Assumption of Risk: Pathfinder is not liable for any legal repercussions, traffic violations, voided vehicle manufacturer warranties, vehicle structural failures, property damage, bodily injury, or safety failures resulting from improper vehicle modification, incorrect installation, or misuse of the equipment.
SECTION 3 - SPECIAL REGULATION FOR POWER & ELECTRICAL SYSTEMS
Our Elite Series LiFePO4 batteries, power stations, and AC/DC conversion kits are high-capacity electrical components.
-
Users must strictly adhere to all operating parameters, maximum current limits, charging thresholds, and temperature guidelines outlined in the product manuals.
-
Pathfinder disclaims all liability for electrical shorts, fires, vehicle burnouts, or personal property destruction caused by unauthorized wiring modifications, improper series/parallel bank configuration, lack of appropriate fusing, physical puncture, or water submersion.
SECTION 4 - PRODUCT ACCURACY, PRICING, AND TYPOGRAPHICAL ERRORS
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
Prices for our products are subject to change without notice. From time to time, information on our site may contain typographical errors, inaccuracies, or omissions that may relate to product specifications, weights, dimensions, capacities, vehicle compatibility charts, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice (including after you have submitted your order).
SECTION 5 - THIRD-PARTY LINKS AND INTEGRATIONS
Certain content, products, and Services available via our Service may include materials or installation frameworks from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials, software integrations, or websites.
SECTION 6 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Pathfinder and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, your improper installation or misuse of any Pathfinder product, your violation of any traffic safety or vehicle compliance law, or your violation of the rights of a third party.
SECTION 7 - LIMITATION OF LIABILITY
IN NO CASE SHALL PATHFINDER, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, VEHICLE DAMAGE, PROPERTY DAMAGE, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT.
MAXIMUM LIABILITY CAP: BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL PATHFINDER’S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO PATHFINDER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE LIABILITY CLAIM.
SECTION 8 - GOVERNING LAW & CLASS ACTION WAIVER
-
Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
-
Class Action Waiver: YOU AND PATHFINDER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Any dispute resolution proceedings, whether in arbitration or court, will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
